Terms & Conditions

KegHop is the new service from DeskBeers allowing you to enjoy craft beer on tap in the comfort of your office. DeskBeers typically sells 30-litre “KeyKeg” brand kegs filled with beer from UK independent breweries (“Keg”).

By signing up to KegHop and agreeing to these Terms and Conditions you are entering into an agreement with DeskBeers Limited (“DeskBeers”, “We”, “Us”), a limited liability company incorporated in England and Wales under company number 09262678, whose registered office is at 2A Tower Workshops, Riley Rd, London SE1 3DG, United Kingdom, and whose VAT registration number is 197170972.

DeskBeers can supply everything you need to run a craft beer tap in your office: supply and installation of equipment, supply and rotation of great craft beer, and regular line cleaning to keep your beer in tip-top condition. We recommend that you follow our recommended refrigeration, maintenance and cleaning schedule to ensure that your beer is stored safely and tastes as good as it should; we cannot guarantee the quality and longevity of your beer if you do not.

When you place an order for KegHop you will also be agreeing to these Terms and Conditions.

1. BEER

Unless otherwise agreed in advance, We will supply a Keg of beer to your office every fortnight. We will guarantee that the beer in the Keg will remain in good condition for up to 5 days after opening; in order to prolong the life of your Keg we strongly recommend that your Keg is refrigerated and that the Beer Lines are cleaned every 2 weeks.

2. CLEANING OF THE BEER LINES

Beer lines are draft beer dispensing tubes connecting the Keg to the dispensing “tap” (“Lines”), which require regular cleaning to avoid buildup of bacteria and to meet health and safety guidelines (“Line Cleaning”). We recommend Line Cleaning once every 2 weeks and, in addition, each time the Keg is changed. DeskBeers cannot accept liability for any issues arising from Lines being cleaned less frequently.

Line Cleaning is charged as a standard “call-out” rate, currently £60. If you agree to a regular fortnightly Line Clean you will receive a 25% discount on the Line Cleaning charge, making the fee payable £45. Line Cleaning must be performed each time the Keg is changed.

3. REFRIGERATION

To maintain the quality and freshness of the beer the Kegs should be refrigerated. An mains outlet is required to plug in the refrigeration unit. We can supply and install a brand new or reconditioned refrigeration unit for you. All reconditioned units are supplied with a 3 month guarantee and all new units come with a one year guarantee. After the guarantee period we can maintain and fix the refrigeration unit for you but you will need to pay for all parts and labour.

5. PRICING AND PAYMENT

Keg: a 30-litre Keg is £150 plus VAT. Larger and smaller Kegs, and Kegs of products other than beer, may be made available in the future. These will be priced on a case by case basis.

Line Cleaning:

We operate a standard “call-out” charge of £60. This charge is applicable per line cleaned, to the delivery of a new Keg, and in cases where an engineer is required to fix a dispense issue. This fee will be reduced to £45 for customers taking a regular fortnightly Line Clean, and waived in the instance where a dispense issue is covered by guarantee.

Refrigeration Units:

Maintenance and repair of refrigeration units: free during the guarantee period (one year from installation for a brand new unit and 3 months from installation for a reconditioned unit), thereafter parts and labour are payable.

All prices exclude VAT unless otherwise stated.

We reserve the right, at our absolute discretion, to raise our prices at any time for reasons including, but not limited to, price increases from our suppliers and partners. If we raise our prices, we will notify you beforehand and provide the option to cancel your KegHop service.

We will invoice you in advance before your first delivery of KegHop, and your invoice must be paid in full prior to delivery. Thereafter you will be offered standard terms of 7 days unless agreed in writing in advance. Payment must be made by bank transfer.

6. ORDER

When you sign up to KegHop you will place an order with us specifying how frequently you want a Keg delivered, if and how frequently we are to provide Line Cleaning services and whether you are purchasing a new or reconditioned refrigeration unit from us.

7. CANCELLATION AND REFUNDS

You can cancel or amend your order by no later than 12 noon on the working day prior to your scheduled service.. If you notify us after this time then we will make every effort to accommodate your request, but may still have to charge for services. You can also request delivery of (a) Keg(s), a Line Clean or a change to your Line Cleaning schedule at any time by emailing hello@deskbeers.com. We will endeavour to arrange a Line Clean or other appointment as soon as we can.

If we are unable to fulfil a Keg order after accepting payment we may refund your money and cancel the contract which relates to the Keg order in question.

8.DELIVERY POLICY

Any times or dates stated for delivery are estimates only. We do not accept liability for any failure to deliver at or on a the given times or dates.

You are responsible for giving us appropriate delivery instructions and for making suitable arrangements to ensure that you receive your delivery. If we are instructed by you to leave any Kegs outside the property at the delivery address you stated on the Website and such Kegs are stolen, you will not hold us responsible and acknowledge and agree that we will have no liability to you whatsoever. You will not hold us responsible for any delivery delays which result from circumstances outside of our control.

We may suspend or cancel any accepted order for KegHop immediately at our reasonable discretion if you breach any of these Terms and Conditions.

If any of our Kegs arrive in a damaged or unsatisfactory state then please contact as soon as possible by email on hello@deskbeers.com.

Upon taking delivery of your order, you, the recipient or the person accepting the delivery on your behalf, may be asked to provide formal identification to prove that they are aged 18 years or over. If you, the recipient or the person taking delivery on your behalf is unable to produce ID to the satisfaction of the courier, the courier will not be permitted to leave the Kegs with the intended recipient and the delivery will be returned to us.

We use trained staff to install the Kegs and clean Beer Lines.

Delivery charges: Delivery charges will usually be included in the Line Clean price, however if this is not the case we will advise you at the time of placing your order.

9. LINE CLEANING AND MAINTENANCE SCHEDULE

We will agree a regular day and time to attend for Line Cleaning on your Keg (if you request this service). You are responsible for ensuring that our staff are permitted access to the Keg at the agreed time to carry out the Line Cleaning. If our staff are not able to gain access we will still charge you for the visit.

You can increase or decrease the frequency of the visits or request a one off Line Cleaning visit or an appointment to fix a problem by emailing hello@deskbeers.com. Any one-off visits will be charged at the agreed rate of £60 per visit. A discounted fee of £45 per Line Clean will be charged to customers who agree a regular fortnightly Line Clean.

10. PROMO CODES

Promo codes allow customers to obtain a discount and are non-transferable and must be used in accordance with these terms and conditions of use.

Promo codes have no monetary value.

A promo code cannot be used in conjunction with any other offer and may be withdrawn by us at any time, at our discretion.

11. CIRCUMSTANCES BEYOND OUR CONTROL

Adverse weather conditions

During adverse weather conditions (including but not limited to heavy snow, ice, flooding or high winds), we may not be able to deliver orders on time. This is outside of our control and we cannot accept responsibility for the late delivery of the order. Therefore, in the event of adverse weather conditions, we aren't able to refund or offer re-delivery of affected orders.

Force Majeure

We shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond our reasonable control.

12. LIMITATION OF LIABILITY

Nothing in these Terms and Conditions limits or excludes our liability for any: (a) death or personal injury caused by our negligence; (b) loss suffered by you as a result of your reliance on any fraudulent misrepresentation made by us to you; or (c) other liability which may not by law be limited or excluded. Subject to the clause below, you agree that we shall not be liable for any: (a) direct loss, claim or damage, including loss or damage caused by your handling of the Kegs and in particular any spillages or breakages; (b) indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind (including but not limited to lost savings or loss or corruption of data); or (c) loss of profit (whether direct or indirect), in each case whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with: (i) use of this Website or its contents or any competitions or prize draws which are entered via the Website; (ii) failure or delay in the use of any component of the Website or any service including, without limitation, any unavailability of the Website or the services irrespective of duration of any period of unavailability; or (iii) use of or reliance upon any information, material, software, Beers, services and related graphics obtained through the Website, in all cases even if we have been forewarned of the possibility of such loss or damage.

Without limiting the effect of this clause, due to the inherent risks of using the Internet, we cannot be liable for any damage to, or viruses that may infect, your computer equipment or any other property when you are using or browsing the Website. The downloading or other acquisition of any materials or information through the Website is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system or loss of data that results from the downloading or acquisition of any such materials.

You agree to indemnify us against any claims or legal proceedings that may arise through your use of the Website or from any breach of these Terms and Conditions by you.

We will notify you of any such claims or proceedings and keep you informed as to the progress of such claims or proceedings.

13. DATA PROTECTION AND PRIVACY

We will only use any personal information that we may collect about you in accordance with our DeskBeers Privacy Policy. The Privacy Policy forms an essential part of these Terms and Conditions and it is important that you read it. By accepting these Terms and Conditions you also accept and consent to our Privacy Policy.

14. GENERAL

Any failure or delay by us to enforce any of our rights under these Terms and Conditions is not to be taken as or deemed to be a waiver of that or any other right unless we acknowledge and agree to such a waiver in writing.

If any clause or part of a clause of these Terms and Conditions is, or becomes, invalid, illegal or unenforceable, the remainder of these Terms and Conditions shall remain valid and enforceable and the offending provision shall be deemed to have been amended to the extent necessary in order for it to comply with all applicable laws whilst reflecting its original intention.

These Terms and Conditions and the DeskBeers Privacy Policy set out the full extent of our obligations and liabilities concerning the services we provide via the Website and replace any previous agreements and understandings between us and you.

You shall have no remedy in respect of any untrue statement made to you upon which you relied in entering into these Terms and Conditions other than any remedy you may have for breach of the express terms of these Terms and Conditions.

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with English law and the parties irrevocably agree to submit to the exclusive jurisdiction of the English courts.
